En el presente artículo, el autor analiza la adecuada reinserción social del recluso como finalidad de la ejecución de la pena privativa de la libertad. Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Por último, Arocena examina los condicionamientos que impone un arquetipo de Estado social y democrático de Derecho, a la hora de adherir a uno u otro de esos modelos, (...) y finalmente expone sus razones a favor de un paradigma de readaptación social mínimo. The adoption of artificial intelligence (AI) in small and medium-sized enterprises (SMBs) has emerged as a key strategy for improving quality management. This article discusses the main benefits and challenges of implementing AI in this context. A systematic review of the academic literature and relevant business reports was carried out, in order to collect and analyze empirical evidence on the application of AI in the quality management of SMEs, obtaining as results that the main benefits of the implementation of AI (...) in the quality management of SMEs include: Improved data-driven decision-making, process automation and error reduction, early detection of quality issues, customization of products and services, and resource optimization and cost reduction. On the other hand, the main challenges were: Lack of knowledge and skills in AI, high implementation costs, concerns about data security and privacy, resistance to cultural change, and integration of AI with existing systems and processes, concluding that the implementation of AI in SMB quality management offers significant benefits, but it also entails challenges that must be addressed strategically. SMEs that manage to overcome these challenges will be able to take advantage of the competitive advantages offered by AI, improving their efficiency, quality and adaptability in an increasingly dynamic business environment. We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. Peirce, needed for the construction of theories. (shrink)

We integrate dualistic conceptions of the real with Peirce's perspectives about reality and abduction, emphasizing the concept of reason underlying Peirce's thoughts. Peirce's abduction is related to the notions of retrogression and grounding in Hegel, later re-encountered in Hansonian-abduction. Abduction in turn is considered in relation to abstraction acquiring its fullest sense as a stage in the process of producing a theory. The process is iterative and self improving, it incorporates ``turbid thinking'' making it increasingly ``clear'' at successive iterations that (...) incorporate the lessons taught by failed predictions, i.e., refutations. The cycle of thoughts promoted by doubts comes to rest when belief is reached. We discuss how this coming to rest depends on a criterion for cessation of doubts. The observation is illustrated with two different criteria, one proposed by Mach that only demands analogy and the criteria of dualists such as Goethe and Whewell that inspire the present work. Hence, it is possible to produce, and socially accept, imperfect theories unless we demand the highest level of rationality, avoiding any leftover of the turbid thoughts that have been used in the early developments. This work rests upon the existence of some objective form of reason. Influenced by a constructivist, Piagetian, perspective of science, we propose and discuss a small number of conditions that we identify as characteristics of rational abduction: rules for the rational construction of theories. We show how a classical example of belief that satisfies today's most common definition of abduction does not match the standards of rational retroduction. We further show how the same rules indicate the partial detachment of Special Relativity from the observable world, a fact actually known to Einstein. We close arguing that there is an urgent need to develop a critical epistemology incorporating dualistic perspectives. (shrink)

La Universidad Nacional San Luis Gonzaga, Ica-Perú, debido al Covid 19 se adecuó a la virtualidad implementando el aula virtual Laureasea. Esta investigación se realizó durante el semestre académico 2021-1. Objetivo: analizar de qué manera la educación virtual mejora el desempeño docente. Participaron 430 docentes de las 24 facultades respondiendo una encuesta virtual. Resultados significativos: 80% dictó una clase virtual por primera vez, 60% tenía acceso a una aula virtual, 68% ha mejorado su desempeño y 75% prefiere las clases presenciales. (...) Conclusiones: La educación virtual mejora significativamente el desempeño docente y prefieren el dictado de clases presenciales. (shrink)

This article gives a conceptual review of the e-value, ev(H|X) – the epistemic value of hypothesis H given observations X. This statistical significance measure was developed in order to allow logically coherent and consistent tests of hypotheses, including sharp or precise hypotheses, via the Full Bayesian Significance Test (FBST). Arguments of analysis allow a full characterization of this statistical test by its logical or compositional properties, showing a mutual complementarity between results of mathematical statistics and the logical desiderata lying at (...) the foundations of this theory. El autor pasa revista a la concepción de la historia como disciplina que exhibe el filósofo Fernando Miguel Pérez Herranz. El motivo de este concienzudo análisis es la publicación en marcha del magno proyecto Más allá de imperios y naciones (4 vols.) iniciado en 2023 y que ya cuenta con dos tomos en el mercado: Rutas, fronteras y complejidad y Singularidad imperial: del Mediterráneo al Atlántico. Esta concepción del estatuto gnoseológico de la historia tiene en Lindos y tornadizos (2016) y (...) en Ambiguus proetus (2019) dos momentos esenciales que dibujan el paso Herranz a su perspectiva (la morfología filosófica) en el debate entre Gustavo Bueno y Ricardo Sánchez Ortiz de Urbina a cuenta del sujeto trascendental. En tal contexto cobran relevancia las hipercategorías formuladas por Pérez Herranz y cuyo estatuto resulta problemático. (shrink)

La propuesta gnoseológica de Ricardo Sánchez Ortiz de Urbina de retirar al Ego trascendental sus funciones gnoseológicas no es inocua para el materialismo. Tiene consecuencias ontológicas y socio-antropológicas. En esta primera parte se ilustran las primeras, discutiendo las diferencias entre el materialismo filosófico del Gustavo Bueno, tal como aparece formulado en sus textos canónicos, y el materialismo fenomenológico, que propone Urbina a propósito de lo «trascedental». Para ello uso como filtro crítico un tercer materialismo, el de Gilles Deleuze, sobre (...) cuya filosofía nómada sólo se efectúan unos apuntes esquemáticos, pero suficientes para «espantar» a los fantasmas de la razón. La referencia a Deleuze en el debate sobre las consecuencias ontológicas que trae el planteamiento de Urbina es obligada, no sólo por las prevenciones que manifiesta Urbina en su texto «a causa de su radicalidad», sino sobre todo, porque sus propuestas estaban ya presentes (como referencia implícita) en las propias formulaciones iniciales del materialismo filosófico. 'Revisão do Pensamento Conservador' apresenta alguns resultados do Projeto Temático Fapesp 'Linhagens do Pensamento Político-Social Brasileiro' desenvolvidos por seus integrantes e outros pesquisadores interlocutores do projeto. O livro procura oferecer uma visão de conjunto das configurações assumidas pelo pensamento conservador em diferentes momentos da vida intelectual brasileira, em algumas tradições políticas e em diferentes autores, como Visconde do Uruguai, José de Alencar, Alberto Torres, Gilberto Freyre, Gustavo Corção e outros.

Several scholars have criticized the histories of early modern philosophy based on the dichotomy of empiricism and rationalism. They view them as overestimating the importance of epistemological issues for early modern philosophers (epistemological bias), portraying Kant's Critical philosophy as a superior alternative to empiricism and rationalism (Kantian bias), and forcing most or all early modern thinkers prior to Kant into the empiricist or rationalist camps (classificatory bias). Kant is often said to be the source of the three biases. Against this (...) criticism, this paper argues that Kant did not have the three biases. However, he promoted a way of writing histories of philosophy from which those biases would naturally flow. (shrink)

The rapid development of vaccines against COVID‐19 represents a huge achievement, and offers hope of ending the global pandemic. At least three COVID‐19 vaccines have been approved or are about to be approved for distribution in many countries. However, with very limited initial availability, only a minority of the population will be able to receive vaccines this winter. Urgent decisions will have to be made about who should receive priority for access. Current policy in the UK appears to take the (...) view that those who are most vulnerable to COVID‐19 should get the vaccine first. While this is intuitively attractive, we argue that there are other possible values and criteria that need to be considered. These include both intrinsic and instrumental values. The former are numbers of lives saved, years of life saved, quality of the lives saved, quality‐adjusted life‐years (QALYs), and possibly others including age. Instrumental values include protecting healthcare systems and other broader societal interests, which might require prioritizing key worker status and having dependants. The challenge from an ethical point of view is to strike the right balance among these values. It also depends on effectiveness of different vaccines on different population groups and on modelling around cost‐effectiveness of different strategies. It is a mistake to simply assume that prioritizing the most vulnerable is the best strategy. Although that could end up being the best approach, whether it is or not requires careful ethical and empirical analysis. (shrink)

This paper discusses Immanuel Kant’s views on the role of experiments in natural science, focusing on their relationship with hypotheses, laws of nature, and the heuristic principles of scientific enquiry. Kant’s views are contrasted with the philosophy of experiment that was first sketched by Francis Bacon and later developed by Robert Boyle and Robert Hooke. Kant holds that experiments are always designed and carried out in the light of hypotheses. Hypotheses are derived from experience on the basis of a set (...) of heuristic principles. The function of experiments is testing hypotheses in order to either reject them as false, or else to transform them into empirical laws of nature. To this end, we must integrate the hypotheses that are confirmed by experiments with the a priori principles which are the foundations of natural science. Compared with Bacon, Boyle, and Hooke, Kant has elaborate views on the one hand, on how our theoretical and pre-theoretical assumptions bear on experimental practice, and on the other hand, on how the results of experimental activity can be integrated with theories to advance our knowledge of nature. However, Kant overstates the dependence of experiments on theories. (shrink)

The conventional wisdom is that the best way to alleviate poverty is to provide the maximum freedom for individual entrepreneurs and corporations to create wealth. Drawing on the case of Latin America, this article contends that there are serious defects in analyses based on such assumptions. New technologies and restructuring of international capitalism have accelerated wealth creation worldwide but amid growing inequalities. Technology is mainly controlled by large multinational corporations and not directed at relieving the deprivation suffered by the world's (...) poor. Pervasive, persistent economic inequality and lack of access to appropriate education and training have all been significant in Latin America's failure to develop rapidly during the twentieth century. Most successful “latecomer” countries in the past two hundred years have adopted heterodox autonomous growth strategies, and the authors suggest that such strategies are necessary now to counter the powerful processes that sustain inequality. En Muerte y alteridad (2002), de reciente publicación en lengua española (2018), Byung-Chul Han analiza una trayectoria filosófica que atraviesa el pensamiento de Kant, Heidegger y Lévinas para señalar la que identifica como una postura caracterizada por la interioridad, desde la cual se entiende al yo como positividad unitaria frente a la negatividad de lo heterogéneo, la alteridad y la muerte. Estas premisas incurrirían en solipsismos, aporías y contradicciones que nos proponemos examinar, a fin de afinar y valorar críticamente la (...) caracterización llevada a cabo por Han. Tanto el heroísmo del yo como del amor constituirían, concluye el filósofo de origen coreano, respuestas equivocadas al hecho de la muerte, proponiendo a este respecto una apertura a la exterioridad de rasgos budistas que implicaría un vaciamiento del yo. Esta alternativa, de ecos religiosos, invita a una reflexión sobre la naturaleza de su proyecto filosófico, no solo con respecto al afrontamiento de la muerte, sino como respuesta a las problemáticas de la modernidad. Cinematic virtual reality (CVR) offers filmmakers a wide range of possibilities to explore new techniques regarding movie scripting, shooting and editing. Despite the many experiments performed so far both with both live action and computer-generated movies, just a few studies focused on analyzing how the various techniques actually affect the viewers’ experience. Like in traditional cinema, a key step for CVR screenwriters and directors is to choose from which perspective the viewers will see the scene, the so-called point of view (...) (POV). The aim of this paper is to understand to what extent watching an immersive movie from a specific POV could impact the narrative engagement (NE), i.e., the viewers’ sensation of being immersed in the movie environment and being connected with its characters and story. Two POVs that are typically used in CVR, i.e., first-person perspective (1-PP) and external perspective (EP), are investigated through a user study in which both objective and subjective metrics were collected. The user study was carried out by leveraging two live action 360° short films with distinct scripts. The results suggest that the 1-PP experience could be more pleasant than the EP one in terms of overall NE and narrative presence, or even for all the NE dimensions if the potential of that POV is specifically exploited. Por outras palavras, tenta-se dar subsídios que assegurem, pelo menos teoricamente, a formação de uma consciência educativa (democrática) contraposta à lógica reducionista e positivista que sempre tem caracterizado esse mesmo tipo de consciência. Igualmente (...) é apontado que, muito provavelmene, só uma "co-gestão" escolar, tal como o conceito é habitualmente entendido, é possível de garantir o re-nascimento e mesmo a sobrevivência do espírito democrático educacional. /// Sur la base de textes-clés d'institutions internationales tels que l'OCDE ou l'UNESCO, et surtout à partir de la Loi Cadre du Système Educatif Portugais, l'auteur vérifie la façon dont ces textes, et spécialement ce dernier, peuvent garantir la pluralité des idées dans l'institution scolaire. Aujourd’hui, le thérapeute psychanalytique de couple ( tpc ) ne se réfère que rarement dans sa pratique au sexuel et à la sexualité. L’auteur étudie cette évolution en proposant deux hypothèses. Les orientations théoriques les plus répandues parmi les tpc auraient-elles une influence sur la difficulté à intégrer le sexuel et les troubles sexuels du couple dans l’analyse des cas? La spécificité de ce cadre, un couple/un analyste, n’y joue-t-elle pas un certain rôle? L’auteur rappelle le travail d’auto-analyse du thérapeute (...) en soulignant que pour comprendre les dynamismes en jeu on doit entendre le cadre comme développant un espace psychique inédit, un chaudron néogroupal. Dapprima viene ripreso il ragio¬namento sulla continuità del pensare e del suo essere sempre in atto, e poi si ragiona sulle proposizioni portatrici di quella tesi. Si vedrà che l’enunciato sulla continuità del pensare va incontro a considerevoli difficoltà sia quando afferma che per effetto dell’emendatio ossia la fase in cui la mens si è liberata dalle opinioni dubbie o inganne¬voli le sostituisce con (...) altre migliori, sia per ef¬fetto della temporalità degli atti della mente. L’indagine riguarda dunque quelle formulazioni lessiacali in cui il filosofo ha scritto che la mente semper actu cogitat, e in cui ha impiegato le forme verbali cogito e sum cogitans. (shrink)

Didacticism, romanticism, and classicism are the possible schemata for the knotting of art and philosophy, the third term in this knot being the education of subjects, youth in particular. What characterizes the century that has just come to a close is that, while it underwent the saturation of these three schemata, it failed to introduce a new one. Today, this predicament tends to produce a kind of unknotting of terms, a desperate dis-relation between art and philosophy, together with the pure (...) and simple collapse of what circulated between them: the theme of education. Whence the thesis of which this book is nothing but a series of variations: faced with such a situation of saturation and closure, we must attempt to propose a new schema, a fourth type of knot between philosophy and art. Among these “inaesthetic” variations, the reader will encounter a sustained debate with contemporary philosophical uses of the poem, bold articulations of the specificity and prospects of theater, cinema, and dance, along with subtle and provocative readings of Fernando Pessoa, Stéphane Mallarmé, and Samuel Beckett.
